Court Enjoins “Termination” of Congestion Pricing

In a major victory for New York’s congestion pricing program, yesterday Judge Liman of the Southern District of New York granted a preliminary injunction to our clients, the MTA and TBTA, and to the New York State and New York City Departments of Transportation, that bars the Trump Administration from withholding billions in federal funding for refusing to comply with the unlawful “termination” of congestion pricing. The court found that Plaintiffs are likely to ultimately succeed in showing the Administration has no right to stop congestion pricing, and that choosing between shutting down congestion pricing or losing out on funding and approvals for other critical projects would irreparably harm the Plaintiffs and the public interest.
