Kaplan Martin Achieves Major Victory for MTA and TBTA

Congestion pricing survives Trump Administration’s efforts to block the program

We are so honored to have achieved this significant victory today for our clients the MTA and TBTA. In the case MTA, et al. v. Duffy, et al. (S.D.N.Y.), Judge Liman issued an emergency injunction to prevent the Trump Administration from taking steps to withhold billions of dollars in funding and necessary approvals for NY transportation projects in order to punish our clients for continuing to operate congestion pricing in Manhattan. The current congestion pricing program has not only proven already to be a huge success, but had been suggested to our clients by officials in the first Trump administration and then approved during the Biden administration. As Robbie Kaplan, citing recent United States Supreme Court decisions, argued in court, allowing one administration to blithely terminate major public works contracts entered into by previous administrations would be a “recipe for chaos” that would lead to “unacceptable instability” in administrative law.
