
Kaplan Martin Helps Facilitate the Implementation of ‘Congestion Pricing’
We are extremely proud of the role we played in facilitating the implementation of the “New York Central Business District Tolling Program,” aka, ‘congestion pricing.’ In partnership with our environmental law co-counsel at Sive, Paget & Riesel, we prevailed before two judges in the Southern District of New York (Liman and Seibel) and a third in the District Court in New Jersey (Gordon), with the Third Circuit denying an emergency stay request —thus thwarting multiple statutory and constitutional challenges against the program. We are so gratified to represent the Metropolitan Transportation Authority in its critical efforts to enact congestion pricing in order to reduce traffic, improve air quality, and help fund much-needed improvements to NYC’s public transportation system and will continue to vigorously defend the legality of this important initiative.
